California Probate Fees

In discussing the alternatives of estate planning, one question which typically arises is the cost to Probate an Estate. Translation: How much does the attorney or executor get paid? What follows are typical calculations for the Statutory Fees for Executors and Attorneys under California Law. These are fees only and do not include the various costs associated with a probate, such as filing fees, probate referee, publication fees, and more.

These Calculations are found in California Probate Code Section 10800.  These are the combined fees for the attorney and the executor.  In the event assets are sold during the probate, or if there are other extra duties, there may be 'extraordinary' fees.  These fees also do not include any Federal Estate Taxes or income taxes.
